TRIBUNAL DE EXCEÇÃO

Tramitam na Câmara dos Deputados o processo de impeachment da presidenta da República, Dilma Rousseff, e o processo de cassação do presidente da Câmara, Eduardo Cunha.
Há uma assimetria entre os dois processos. No primeiro deles, verifica-se uma profusão de atropelos regimentais. Num deles, o relatório do deputado Jovair Arantes considerou fatos anteriores a 2015, alheios ao atual mandato, sem que fosse garantido à defesa o direito de impugnar tais preliminares.
Já no processo que tramita contra Eduardo Cunha no Conselho de Ética, os prazos foram refeitos duas vezes. Houve mudança de relator, e o advogado pôde exercer amplo direito de defesa, lançando mão de graves manobras a fim de impedir o andamento do processo.
A assimetria entre os dois processos tem origem na condução dos trabalhos. Não por acaso, o pedido de impeachment foi aceito pelo presidente da Câmara no mesmo dia em que o PT decidiu votar pela admissibilidade do processo de cassação de Cunha por corrupção. Réu no Supremo Tribunal Federal e envolvido em denúncias gravíssimas, Eduardo Cunha carece de imparcialidade para julgar a presidenta. E os dois, Jovair Arantes e Cunha, redigiram a quatro mãos o relatório favorável à cassação.
A acusação contra Dilma diz respeito à publicação de seis decretos orçamentários e à concessão de subsídios ao Plano Safra para agricultura familiar. Esses decretos respeitam a Lei Orçamentária Anual, que, no seu artigo 4°, permite a edição de decretos para fins de remanejamento, desde que não firam o superávit primário. Num cenário de contingenciamento, tais decretos tiveram o condão não de aumentar despesas, mas mudar sua natureza.
Todo o procedimento seguiu os padrões que o Estado brasileiro sempre adotou. Os subsídios aos agricultores familiares no Plano Safra foram feitos regularmente, num contrato de prestação de serviços entre o governo e o Banco do Brasil. Não houve operação de crédito, como (mal) entendido pela acusação. Dilma nem sequer atuou nesse contrato, de responsabilidade do Ministério do Desenvolvimento Agrário.
Esta denúncia é desprovida de elementos jurídicos e tem origem no inconformismo daqueles que perderam a eleição em 2014.
Não existe crime que tenha sido praticado pela presidenta Dilma. Sem crime de responsabilidade, impeachment é golpe. Dilma é pessoa honesta, dedicou sua vida à construção da cidadania do povo brasileiro, e sempre pautou sua atividade política por métodos republicanos. Foi eleita com 54 milhões de votos e, agora, tornou-se vítima de uma conspiração, patrocinada por Eduardo Cunha em conluio com Michel Temer. Condenar uma pessoa inocente, por ambição ou vingança, caracteriza um tribunal de exceção, que afronta a Constituição Federal.
O difícil momento pelo qual passa a economia do país deve-se a uma conjunção de fatores. Não podemos resolver a crise atacando o valor maior da democracia, que é a soberania popular. Críticas ao governo devem ser feitas, e o momento para substituí-lo é 2018, através do voto. Até lá, o caminho possível para a superação da crise passa pela derrota do impeachment, pela adoção de medidas que viabilizem a retomada do crescimento e da proteção do emprego e, sobretudo, pelo enfrentamento das reformas necessárias, em especial a reforma política.
